Terms of Use

1. Agreement

These Terms of Use (“Terms”) are an agreement between you and Life Like (“Life Like”, “we”, “us” or the “Developer”) covering the MapScore mobile application and its updates (the “App”) and mymapscore.com (the “Website”). Our Privacy Policy explains how data is handled and forms part of these Terms.

You must be old enough to enter a binding contract where you live, or have the permission of a parent or legal guardian who agrees to these Terms on your behalf. The App is not intended for children under 13.

2. Licence

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and use the App on Android devices that you own or control, for your own personal, non-commercial use. You may not, and may not allow anyone else to:

• copy, modify, translate, sell, rent, lease, distribute or create derivative works of the App;
• reverse engineer, decompile or disassemble the App, except to the extent applicable law expressly permits it;
• bypass, disable or interfere with licensing, purchase verification, security or other protective features;
• remove or alter any proprietary notices; or
• use the App to build or train a competing product or service.

The App is licensed, not sold. We reserve all rights not expressly granted.

3. Your device, your movements

MapScore records the location of the device it is installed on. You agree that you will use the Apponly on your own device and only to record your own movements. You must not:

• install or use the App on another person’s device, or on a device carried by another person, without that person’s informed and freely given consent;
• use the App to track, monitor, stalk, harass, intimidate or surveil any person, including a partner, family member, employee or child, except where you have clear legal authority and that person’s consent where the law requires it;
• use the App, or any data, export or image it produces, for any unlawful, harmful, fraudulent or deceptive purpose, or in violation of anyone’s privacy or other rights; or
• use the App in any way that breaches applicable law, including data protection, surveillance, employment and consumer protection laws.

You are solely responsible for all use of the App on your devices, for all data it records, and for anything you export, back up, share or disclose. The Developer does not receive, monitor or control that data and is not responsible for how it is used.

4. Not for navigation, safety or evidence

MapScore is a personal diary. It is not a navigation, emergency, safety, medical, fitness, fleet, employment or child-monitoring tool. Do not rely on it to find your way, to locate a person, in an emergency, or for any decision where inaccurate or missing data could cause harm, loss or legal consequences. Its records are not certified and are not intended as evidence for legal, insurance, tax, employment or official purposes. Do not interact with the App while driving or in any situation that requires your attention.

5. Accuracy and availability

Location, activity, distances, durations, place names, transport modes, explored areas, countries, scores and all other information in the App are estimates. They may be inaccurate, delayed or incomplete because of GPS signal, device hardware, Android background limits, battery optimisation, manufacturer restrictions, permissions, map data and other factors outside our control. Recording may stop or have gaps. The App uses battery, storage and, for optional online features, mobile data. We do not guarantee that the App will be available, uninterrupted, error-free or compatible with your device.

6. Subscriptions and purchases

• Google Play. All purchases are made through Google Play and are also subject to Google Play’s terms and policies. Google processes your payment; we never receive your payment details.
• Price. The price, currency, billing period and any taxes are shown in Google Play before you confirm a purchase, and that is the price you agree to pay.
• Automatic renewal. Subscriptions renew automatically at the end of each billing period, and you are charged through Google Play, until you cancel. You can cancel at any time in Google Play › Payments & subscriptions › Subscriptions. Cancellation takes effect at the end of the current billing period.
• Free trials. Free trials, when offered, are available to eligible new customers as determined by Google Play. Unless you cancel before the trial ends, the subscription starts and you are charged automatically.
• Price changes. We may change prices. Google Play will notify you of changes to an existing subscription as its policies require.
• Refunds. Refunds are handled by Google Play under its refund policies. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods or unused features.
• Lifetime purchase. A lifetime purchase is a one-time payment that unlocks premium features for as long as we continue to offer and support the App. It refers to the life of the App, not your lifetime, and it is personal to the Google account used to buy it.
• When access ends. If your subscription ends, recording stops. Your existing history stays on your device, where you can still export or delete it.

7. Your data

Your diary belongs to you and is stored on your device. You are responsible for keeping backups. We are not responsible for loss of data, including loss caused by losing or resetting your device, uninstalling the App, clearing its data, a failed update or a forgotten backup password, which cannot be recovered.

8. Third-party services

The App relies on services provided by others, including Google Play, Google Play services, Google Maps, your device’s geocoding service and RevenueCat. When you use Google Maps features in the App, you also agree to theGoogle Maps/Google Earth Additional Terms of Serviceand the Google Privacy Policy. Third-party services are governed by their own terms. We do not control them and are not responsible for their availability, content, accuracy or practices.

9. Intellectual property

The App, the Website, the MapScore name and logo, and all related designs, text, graphics and software are owned by the Developer or its licensors and are protected by intellectual property laws. Open-source and third-party components are provided under their own licences, listed in the App under Settings › Licenses. If you send us feedback or suggestions, we may use them freely without any obligation to you.

10. Changes to the App

We may update, change, suspend or discontinue the App, the Website or any feature at any time, with or without notice, and without liability to you. Some updates may be required to keep using the App.

11. Assumption of risk

You use the App and the Website at your own risk. To the maximum extent permitted by applicable law, you release the Developer from all claims, demands and damages arising out of or relating to your use of the App, the use or misuse of the App or its data by any other person, and any third-party service.

12. Disclaimer of warranties

To the maximum extent permitted by applicable law, the App, the Website and all data, content and information they provide are provided “as is” and “as available”, with all faults and without warranty of any kind. The Developer expressly disclaims all warranties and conditions, whether express, implied or statutory, including any implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, quiet enjoyment and non-infringement, and any warranties arising from course of dealing or usage of trade. The Developer does not warrant that the App will meet your requirements, operate without interruption or error, be secure, record your location accurately or completely, or that defects will be corrected. No advice or information, whether oral or written, obtained from the Developer creates any warranty not expressly stated in these Terms.

13. Limitation of liability

To the maximum extent permitted by applicable law, in no event will the Developer, or its affiliates, contractors, licensors or service providers, be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or use, or for any personal injury, property damage, privacy or data breach, or the cost of substitute services, arising out of or relating to the App, the Website, these Terms, any data recorded, exported or shared, or any use or misuse of the App by you or any other person, whether based on contract, tort (including negligence), strict liability or any other theory, even if the Developer has been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, the Developer’s total liability for all claims arising out of or relating to the App, the Website or these Terms will not exceed the amount you paid for the App in the twelve (12) months before the event giving rise to the claim or, if you paid nothing, ten US dollars (US$10).

These limitations apply even if a remedy fails of its essential purpose, and they form an essential basis of the bargain between you and us.

14. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify and hold harmless the Developer and its affiliates, contractors, licensors and service providers from and against all claims, demands, actions, liabilities, damages, losses, fines, costs and expenses (including reasonable legal fees) arising out of or relating to: (a) your use or misuse of the App or the Website; (b) any data recorded on your devices or exported, backed up, shared or disclosed by you; (c) your breach of these Terms; or (d) your violation of any law or of the rights of any person, including tracking any person without their consent. We may take over the defence of any matter at your expense, and you will cooperate with us.

15. Your statutory rights

Some jurisdictions do not allow certain warranties to be excluded or certain liabilities to be limited. In those jurisdictions, the exclusions and limitations in these Terms apply to the maximum extent the law allows, and nothing in these Terms excludes or limits any liability or right that cannot be excluded or limited by law, such as liability for fraud or, where applicable, for death or personal injury caused by negligence, or mandatory consumer rights.

16. Termination

Your licence ends automatically, without notice, if you breach these Terms. We may also suspend or end your access to the App or the Website at any time. You may stop using the App at any time by uninstalling it; uninstalling does not cancel a subscription, which you must cancel in Google Play. Sections 3, 4, 5 and 7 to 18 survive termination.

17. Governing law and disputes

These Terms, and any dispute arising out of or relating to them, the App or the Website, are governed by the laws of the jurisdiction in which the Developer is established, without regard to conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. The courts of that jurisdiction have exclusive jurisdiction, except where the mandatory law of the country in which you live gives you the right to bring proceedings in your local courts.

Before starting any claim, you agree to contact us at info@mymapscore.com and try to resolve the dispute informally for at least 60 days. To the maximum extent permitted by applicable law, any claim must be brought within one (1) year after it arises, and you agree to bring claims only in your individual capacity and not as a plaintiff or class member in any class, collective or representative action.

18. General

• Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the App and the Website.
• Severability. If any provision is found unenforceable, it will be enforced to the maximum extent possible and the rest of these Terms remain in effect.
• No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
• Assignment. You may not transfer your rights under these Terms. We may assign ours, for example to a successor of the App.
• Force majeure. We are not liable for any delay or failure caused by events beyond our reasonable control.
• No third-party beneficiaries. These Terms do not give rights to anyone else, except as stated in section 14.
• Language. These Terms are written in English. Any translation is for convenience, and the English version prevails.

19. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above shows when they last changed. By continuing to use the App or the Website after a change takes effect, you accept the updated Terms. If you do not agree, stop using the App and cancel any subscription.
